Welcome to Gleamz (“Gleamz,” “we,” “us,” or “our”). Gleamz is an AI-powered assistant that helps users create listings, suggest pricing, communicate with buyers, and sell second-hand items effortlessly.

These Terms of Use (“Terms”) form a legally binding agreement between you and Gleamz. By accessing or using our website, waitlist, or any early-access features (the “Service”), you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old (or the legal age of consent in your jurisdiction, if higher) to use Gleamz. By using the Service, you confirm that you have the right, authority, and capacity to enter into these Terms.

2. No Guarantee of Sale or Price

Gleamz can help you draft listings, suggest pricing, and message buyers, but we do not guarantee that:

Your item will sell.
You will receive a specific price.
A potential buyer will be honest or complete payment.

You are solely responsible for deciding where to list, how to price, and who to sell to.

3. Your Content

“Your Content” means photos, item details, descriptions, messages, pricing goals, and any other material you submit to or through the Service.

You confirm that:

You own Your Content or have the right to use it.
Your Content is accurate and honest (for example, condition, authenticity, or damage).
Your Content does not violate any law, including those related to counterfeit, stolen, or illegal items.

You grant Gleamz a limited, worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, display, and distribute Your Content for the purpose of operating, improving, and developing the Service.

You may request deletion of Your Content by contacting us, but aggregated or anonymized data may be retained for analytics and product improvement.

4. Acceptable Use

You agree not to use Gleamz to:

Sell illegal, dangerous, or stolen items, or items you are not permitted to sell.
Misrepresent an item (for example, selling replicas as originals).
Harass, threaten, or scam other people.
Hack, reverse-engineer, or disrupt the Service.

If we believe you are using the Service in a way that is abusive, harmful, or illegal, we may suspend or block your access.

5. Early Access / Beta Features

The Service is currently offered as a beta or early-access version. Features may change, break, or be removed at any time. You understand that the Service may contain errors and may not function as intended. You agree that your use is “as is” and at your own risk.

6. No Financial, Legal, or Tax Advice

We may suggest listing prices or descriptions, but Gleamz is not your accountant, lawyer, or tax advisor. You are responsible for any taxes, compliance, or reporting related to your sales.

7. Payments and Shipping

Gleamz is not a payment processor or shipping carrier. You are fully responsible for collecting payments, shipping items, handling returns, and resolving disputes with buyers or third-party platforms (such as Depop, eBay, or others).

8. Third-Party Services

The Service may suggest or link to third-party websites or marketplaces. We are not responsible for the content, terms, or actions of any third-party platform. Your use of those platforms is at your own risk and subject to their terms of service.

9. Intellectual Property

All rights in the Gleamz brand, design, code, features, logos, text, and visuals belong to us or our licensors. You may not copy, reproduce, resell, or reuse any part of the Service without our prior written permission.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLEAMZ, ITS FOUNDERS, EMPLOYEES, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim shall not exceed the greater of: (a) USD 50, or (b) the total amount you paid to Gleamz in the three months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including if we believe you are violating these Terms or putting other users or the platform at risk.

13. Changes to These Terms

We may update these Terms periodically. When we do, we will revise the “Last updated” date above. By continuing to use the Service after any changes, you agree to the revised Terms.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

15. Governing Law

These Terms are governed by the laws of the State of Israel, without regard to its conflict of law principles. Any dispute shall be handled exclusively in the competent courts of Tel Aviv, Israel.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
